To use the services provided by Greenseekers as either an advertiser or a job seeker you must agree to the terms and conditions below. Greenseekers may modify this document at any time without notice, with changes being effective immediately upon display on the website, and you will be bound by those changes.

General – Advertisers and Job Seekers

1. All concepts and designs of Greenseekers are owned by Parker Belton ABN 23 895 155 990 T/as ‘Greenseekers’ and you agree not to infringe ‘Greenseekers’ intellectual property rights.
2. To register with Greenseekers you are required to submit a username and password. The protection of these details is entirely your responsibility, along with actions undertaken under your login name. You may change or cancel your registered details by following the prompts. You agree to notify Greenseekers immediately if you notice a breach of your profile.
3. No content on this site may be commercially reproduced or modified, including software and codes.
4. Data extraction tools must not be used on or in connection with this website.
5. The law of Western Australia applies to this agreement and you irrevocably submit to the exclusive jurisdiction of that State.
6. If any part of this agreement is held to be invalid that part will be severed from this agreement and the remainder will continue to be enforceable.

Your Responsibilities as a Job Seeker

1. All information on the Greenseekers’ site is for personal use only. You may download information from this site only for personal use.

Your Responsibilities as an Advertiser

1. To advertise a job position with Greenseekers you must be an employer whose company ethos and policies are consistent with those of Greenseekers. You acknowledge that you have read all information provided by Greenseekers to this effect on its website and believe that you comply with these requirements. You agree to submit a “green statement” when registering with Greenseekers which describes your operations and which will be displayed on your profile. You acknowledge that all information contained in your green statement must be true and correct and not misleading in any way (including by omission).
2. Greenseekers reserves the right to refuse to advertise your position in the event that your green statement does not, in our opinion, sufficiently qualify you to advertise with Greenseekers, in which case any payment made by you will be refunded, less our reasonable administrative fee as published from time to time. In such event, Greenseekers reserves the right to refuse to accept any future request by you to advertise on our website.
3. You are responsible for ensuring that you have the right to upload and distribute any information listed with Greenseekers and you must ensure that none of the content is misleading, fraudulent, illegal or offensive.
4. The term and cost of your agreement with Greenseekers is that outlined in your invoice at time of payment. You will be entitled to advertise your position only for the term of your agreement.
5. You understand that only one job vacancy may be advertised per listing and Greenseekers may make changes to the style or format of your advertisement as it sees fit.
6. Payment is required in accordance with Greenseekers’ schedule of fees and charges, published from time to time on the Greenseekers’ website. All amounts owing to ‘Greenseekers’ ABN 23 895 155 990 are required to be paid in full, prior to display of your advertisement, through the Paypal payment gateway. Please carefully read the Paypal terms, conditions and charges whilst processing your payment.
7. Upon confirmation of your payment, your advertisement will be processed automatically and posted with minimal delay.
8. Notwithstanding that such material may have been accepted by Greenseekers at the time of advertising by you, Greenseekers reserves the right to remove any material subsequently deemed unsuitable by us in our sole discretion, including where we have any reason to believe that your green statement is false or misleading in any respect. In this event no refund will be payable to you of any amounts paid by you to Greenseekers.
9. When advertising with Greenseekers, you agree to comply with all relevant Australian employment laws.
10. Only advertisers approved by Greenseekers in its absolute discretion may access the personal resume database. This information may not be used by you for any purpose other than to assist you to source appropriate personnel. This information may not be shared with any other party.
11. You as an advertiser agree to indemnify and keep indemnified Greenseekers, its agents, contractors and employees (“those indemnified”) from and against all claims, demands, writs, summonses, actions, suits, proceedings, judgments, orders, decrees, damages, costs, losses and expenses of any nature whatsoever which those indemnified may suffer or incur as a result of you advertising on the Greenseekers website, including where you are in breach of this agreement, where Greenseekers is in breach of any law as a result of displaying your advertisement and where losses arise out of any act, neglect or omission by you, your agents, contractors or employees.

Greenseekers’ Responsibilities and Matters for which Greenseekers cannot be held responsible

1. Greenseekers may contact all registered users with notifications of any kind, but will not redistribute any personal information or contact details posted on the site.
2. Whilst Greenseekers will use its best endeavours to provide a high quality service which reliably provides accurate information which is current and free from infection and which maintains the privacy of all users of the database, there are certain losses which you may suffer in connection with your use of this database which Greenseekers does not accept responsibility for. You accept that by proceeding to use this database you release K Belton & LR Parker and each of them and any other proprietor for the time being of Greenseekers from any claim in respect of any loss sustained by you arising out of the following matters:
   1. Any loss incurred by you as result of the position you accept using Greenseekers. Greenseekers does not endorse any jobs, businesses or self employment opportunities on this site. Before commencing any agreement with advertisers on this website you are responsible for deciding if the outcomes will be suitable for you.
   2. Any loss incurred by you as a result of the person you employ using Greenseekers. Greenseekers is a public tool that may be accessed by everyone. Greenseekers cannot guarantee that the people who apply for your advertised position will be suitable for that position. It is your responsibility to advertise appropriately to attract the appropriate personnel and select carefully after making your own investigations into the suitability of the applicant.
   3. Any loss incurred by you as a result of the advertiser misrepresenting its green credentials. Advertisers are required to make their own green statement to justify their place on Greenseekers but Greenseekers cannot investigate the truth of all claims made by advertisers. As a user of Greenseekers you may lodge a complaint regarding the suitability of a particular advertiser for Greenseekers and Greenseekers will endeavour to investigate your complaint.
   4. Any loss incurred by you as result of the information on the Greenseekers database being out of date. Greenseekers will make all efforts possible to ensure that listings are updated frequently, however cannot guarantee that any advertised position will still be available.
   5. Any loss incurred by you as a result of following links from the Greenseekers’ website where those links contain incorrect information. Greenseekers provides links to relevant third party websites for convenience. However these sites are not regulated by Greenseekers and Greenseekers cannot guarantee the accuracy of their contents. You agree to notify Greenseekers immediately if you find any links contain incorrect information or are otherwise harmful or inappropriate.
   6. Any loss incurred by you as a result of service faults. Greenseekers endeavours to provide high quality service, however, you accept that some service faults may occur.
   7. Any loss incurred by you as a result of content on the database being infected or otherwise unsafe.
   8. Any loss incurred by you as a result of a third party gaining access to your personal information as a result of your use of the Greenseekers database. Whilst all efforts are made to keep your information private, this possibility always remains and you accept that this is a risk of use of the internet for which Greenseekers will not be held responsible.
   9. Release of your personal resume to potential employers. If you request Greenseekers to include you in its personal resume database, you acknowledge that this will result in your personal resume being disclosed to potential employers approved by Greenseekers in its absolute discretion, and you accept all consequences associated with such disclosure.
